TERMS AND CONDITIONS  

  

This terms and conditions explain the training services we provide to our candidates, clients and companies. Please read these terms and conditions carefully and make sure that you understand them, before ordering any services. You should understand that by ordering our training services, you agree to be bound by these terms and conditions.  

  

I. DEFINITION  

  • Objective Structured Clinical Examination (OSCE) is based on UK preregistration standards. Candidates are required to act out scenarios that nurses or midwives are likely to encounter when assessing, planning, delivering and evaluating care.   

  

  • CANDIDATES– An individual entering the UK to take a nursing role has up to three months (12 weeks) from the employment start date noted on the certificate of sponsorship to sit the OSCE exam. During this period, they can be legally employed as a preregistration candidate. Applicants must complete the OSCE in the UK at an approved test centre.  

  

  • COMPANY– A company is a legal entity formed by a group of individuals to engage in and operate a business or enterprise. This refers to the candidates’ employer.  

  

  • TRAINING CENTRE- A place where people undergo skills training for work. This refers to Mentor Wise Magnate (MWM), the training provider or it can be a training venue hired by the company to train a number of candidates.  

  

  • MENTOR– Pertains to the tutor, trainer that taught OSCE to the candidate at the training centre that gives support and advice during a period of time.  

  

  1. TRAINING SERVICES 

The Candidate or the company will avail our two (2) weeks training programme. Five (5) days online training and five (5) days mock exams at the training centre. 

  

III. TRAINING ACTIVITIES  

During the OSCE training, the training will be delivered in the forms of online lecture, presentation, return demonstration, personal practices and predictor exams  

  

A. CANDIDATE OBLIGATIONS  

  • The Candidate will be provided by the mentor necessary materials for each activity.  

  

  • In the event that the Candidate is unable to attend the mock exams, the Candidate shall notify the training centre. Failure to notify the mentor six hours before the scheduled time will consider as time used and this will be deducted from the agreed training programme. However, it is the mentor’s discretion if the time will be considered or not to be considered as training day.  

  

  • The Candidate will be informed with the training activities by the mentor as well as the training schedule.  

  

  • The Candidate will be provided with individual feedback every after the lecture or scheduled activities: identifying what activities, strength and weakness of the candidates to improve.  

  

  • The Candidate shall have the obligation to take the training seriously, follow the mentor’s advice and value the given feedback.  

  

  • The Candidate has the obligation to do extra mile on her/his review, like doing home works and case scenarios as part of the training.  

  

  • The Candidate shall recognise that the training programme is intense due to limited training days purchased by the candidate or the company.  

  

  • The Candidate or the Company shall have the obligation to pay the agreed amount to the training centre 5 days before the commencement of the review to ensure that the payment is available. An invoice will be raised, where details of the payment is stipulated.  

  

  • The Candidate understand that this is a nonrefundable training programme.  

  

  • In the event that the Candidate withdrew from the training programme, but has started the training, the payment is not refundable.  

  

  • In the event of training dissatisfaction, the Candidate will provide minimum of three reasons why he/she is not happy with the programme. We love to hear your feedback, but we cannot give refunds on this as you have used up the training hours and materials before you made the complaint.  

  

  • The candidate must comply with all the housekeeping and safety precautions within the building. Personal safety is the priority and must be followed at the appropriate level.   

  

  

IV. MENTOR OBLIGATIONS  

  • The mentor has the obligation to collaborate with the Company, notifying or reporting the candidate performance during the training period. However, this is only done with a written consent from the Candidate and for special cases necessary for the candidate’s support and improvement.  

  

  • The mentor has the obligation to provide the candidates with the training materials that are necessary for the training activities.   

  

  • The mentor will receive the OSCE training payment. However, whatever payment arrangement of the training as agreed between the candidate and the company, our training provider does not want to involve on whatever arrangement they have agreed.  

  

V. TRAINING FEES

   MOCK EXAM   1 skill mock exam for 1.5 hours = £100  + VAT  2 skills mock exam for 3 hours

3 skills mock exam for 6 hours  

= £200  + VAT 

 MWM training appreciates that the payment of the training services will be incurred within 5 days of the issuance of the invoice.  

  

VI. CONFIDENTIALITY  

  • This agreement is between the named Candidate and the Company. All the training materials from the mentor should not be shared to any Third Party.    

  

  • For purposes of this Agreement, the term “training materials and information” shall mean any information that MWM may receive from Client pursuant to this Agreement. MWM will retain its rights to confidentiality, where training materials will only be used as intended or as agreed within the training centre.  

  

  • MWM shall have the right to complain or take legal action against the Clients, Candidates and Company’s, who are sharing and distributing the materials outside its purchase purposes.  

  

  • Both parties shall maintain the Information in confidence with the same degree of care it holds its own confidential information. The client and candidate shall NOT use the information except to perform the training and marketing purposes as per consent of the involve parties.   

  

  • MWM will disclose the information only to its officers and employees directly concerned with the Statements of Work, but will neither disclose the Information to any third party nor use the Information for any other purposes.  

  

  • MWM obligation of nondisclosure and the limitations upon the right to use the Information. The Candidate has the obligation to respect confidentiality at all times.  

  

  

VII. INTELLECTUAL PROPERTY  

  • MWM will retain ownership of any data, information or intellectual property furnished to Candidates and Company in connection with the training.  Hence, Candidate and Company will only use the training materials, for the sole purpose of passing their examination and not to use it outside the agreement.  

  

  • Candidate and Company may not copy, transfer, sell, or otherwise dispose of any training centre Items and materials without the prior written consent of training provider.  

  

  • Candidate and Company do not have the right to retain training materials to be used for their own business agenda and to teach other candidates outside MWM training centre. If this has been found out, MWM has the right to take legal actions against the Candidate and the Company.  

  

VIII. WARRANTY  

 OSCE training should be provided within agreed programme, extended hours are with the discretion of the mentor. The Company is not liable to pay extra on the required oneday predictor exam, in any circumstances the candidate failed for the first time. However, in the event that it is an individual purchase, the Candidate has the choice to come back for desired hours and fees.  

  

IX. MARKETING PURPOSES  

 The training centre has the right to use your success stories, photographs, testimonials and other marketing materials with your consent to be used in all our social media platforms by which there is no financial obligations that will incur to the Candidate and the Company.  

  

X. CANCELLATION & TERMINATION  

  • The candidate or the company may cancel the service by notifying MWM in writing or email, giving 7 days’ notice.  
  • We may terminate or suspend our training services immediately, once the candidate or the company breach the terms and any types of abuse towards the staff and fellow candidate.
